A leading policymaker in the Polish government is saying that the government plans to legalize online gambling by the end of the year.
The prior administration, the conservative Law and Justice (PiS) government, ruled against legalizing online betting a year ago after Ministry of Finance analysts argued that the cost to the state would be "too great." Research analysts claimed that any budget revenues from online gambling would be much lower than expected, whereas the cost of regulating the industry would be too high. However, according to estimates from Merrill Lynch, the investment bank, gross online gambling revenues could reach $48 billion by 2010, making it an extremely profitable business. That would be zł.106 billion. "We cannot control this process anyway and it is better that the budget at least derives some revenue from it," Deputy Finance Minister Jacek Kapica told business journalists. Polish journalists have reported that Poland's change of mind was influenced by last year's European Court of Justice ruling which said that Italy may not use the law to ban foreign online gambling companies from attracting Italian players. In the Placanica case, the Italian court gave examples of countries that have successfully stimulated their economy by allowing online gambling. Gambling is taking off all over Europe. The fourth annual European Gambling Briefing (EGB) is scheduled to take place from 13 - 14 May 2008 in Amsterdam. Focusing on legal and regulatory issues for both the online and land-based industries, the conference will address the practical ramifications of these issues for operators and suppliers building an international gambling business. A key discuss will take place between Christofer Fjellner a member of the European parliament from Sweden and Joel Hasse Ferreira, a member of the European parliament from Portugal on the first day of the conference. These two politicians take a different approach to global gambling laws. Fjellner believes that many European jurisdictions are taking action which results in the violation of the freedom to provide services. Sweden has been criticised by the European Commission for its stance on protectionism of its State Monopoly in gambling, has recently made a surprise legal u-turn. The government has recognised that a Swedish law regarding online gambling advertising may well contravene European legislation. The gaming industry continues to make the headlines across Europe, as in another recent development the French Tennis Federation is attempting to control betting outside stadiums during May’s French Open. This move, if successful, could set new precedents for case law in the industry, and is being monitored with great interest by lawyers and operators alike.
